Terms of Service

Effective date · 11 September 2026

Article 1 (Purpose)

These Terms set the rights and duties between Mo.Moment ("Operator") and users of the Gizmory service (the "Service"). The Service is a personal archive for recording and looking back on the electronic devices you have owned or used.

Article 2 (Definitions)

1. "App" means the Gizmory mobile application.
2. "User" means anyone who uses the Service under these Terms, including guests without an account and signed-in members.
3. "Chronicle" means the personal device history, photos, and diaries you keep on this device.
4. "Community content" means reviews, stories, photos, Device Dex requests, and reports that a signed-in user sends to the server.
5. "Paid features" means Pro functions sold through in-app purchase.

Article 3 (Effect and changes)

1. The Operator posts these Terms in the app and on the web.
2. The Operator may amend the Terms within the bounds of Korean statutes, including the Act on the Regulation of Terms and Conditions and the Personal Information Protection Act.
3. Amendments are announced with the effective date and reasons at least 7 days in advance, or 30 days if the change is adverse to users.
4. Silence or continued use alone does not replace consent where the law requires it. Mandatory rights remain protected.

Article 4 (The Service)

1. The Operator provides:
a. Chronicle recording, viewing, editing, and local backup
b. The Device Dex and Gizmory Magazine
c. Studio features that are turned on in the app
d. Lounge: profiles and avatars, reading and writing posts/comments/replies, category and device browsing, saved posts, reports and blocks, in-app activity notices and reply push notifications
e. Other community features and cloud backup for signed-in users
f. Related features the Operator may add
2. Guests can use core Chronicle features. Posting reviews or stories, writing Lounge posts/comments/replies, saves, reports, blocks, Device Dex requests, and cloud backup require sign-in. Public Lounge posts may be read without signing in. Reply push notifications depend on app settings and device notification permission.
3. The Operator may change or suspend features for maintenance, legal reasons, or improvement. Material impact will be announced in advance where practicable, or afterwards in an emergency.

Article 5 (Accounts)

1. Members sign in with Apple or Google. The Operator does not issue a separate password.
2. You are responsible for the account. You may not lend or transfer it.
3. Children under 14 may not use the Service.
4. You may delete the account in Settings. Your local chronicle remains; the Privacy Policy explains removal of server data and separate photo, report and audit stores.

Article 6 (Paid features)

1. Some features may be paid (Pro). Description, price, and billing cycle follow the purchase screen.
2. In-app purchases follow Apple or Google terms. Cancellations and refunds follow the store policy and applicable consumer law.
3. Auto-renewing subscriptions renew unless you cancel in the store account settings, on the store's timeline.
4. The Operator does not store card numbers.
5. The scope of free features may change, but paid benefits already purchased for a current term will not be taken away unfairly.
6. If Paddle checkout is offered on the web, Paddle.com acts as reseller and Merchant of Record for those orders and handles payment processing, buyer support, and refunds. Before paying, review the Paddle Buyer Terms and Refund Policy and confirm the product, currency, and final amount including any tax shown at checkout. Web checkout is being prepared; availability and the terms shown at checkout control when it is offered. Mandatory consumer rights prevail over these Terms and Paddle policies. Paddle processes card details; the Operator does not receive or store card numbers.
7. Web refund requests may be submitted through Paddle Buyer Support. Applicable refund conditions are governed by the Paddle Refund Policy in force at the time of purchase and applicable law.

Article 7 (Your duties)

You must not:
1. Register false information or use another person's account or payment method
2. Post content that infringes publicity, copyright, or other rights
3. Post abuse, hate, obscenity, spam, or other people's personal information
4. Disrupt the Service, automate access, reverse engineer, or abuse it
5. Break the law or these Terms
The Operator may hide posts, limit use, or report to authorities.

Article 8 (Content)

1. You or the rightful owner retain rights to your personal archive and community content.
2. Only content you publicly post is licensed non-exclusively to the extent necessary for requested storage, display, delivery, formatting, backup and report review. Separate advertising or off-service promotion requires separate permission. Deletion or withdrawal ends public use; necessary legal/dispute copies follow the Privacy Policy.
3. Device Dex, magazine, marks, design and code belong to the Operator or rightful owners. Uses permitted by law are not restricted.

Article 9 (Community use)

1. Pseudonymous publishing and pre-review — Signed-in members can post stories, reviews, and comments under a pseudonymous profile (handle and nickname), not their real name. A story is saved on your device first; only a copy you explicitly submit is sent to the server. Submissions are reviewed by the Operator and published under your pseudonym only after approval, and you must separately consent to public web exposure when you submit.
2. Public web and search indexing — Approved, published stories can be read by anyone at gizmory.app/community without signing in. When the Operator turns on web indexing, search engines may index that content.
3. Prohibited content — You may not post or do the following:
a. Brand or platform tribalism, or looking down on other collectors
b. Harassment, hate speech, or exposing another user's personal information
c. Posts that push a sale or purchase, ads, or spam
d. Links to ROM files or other illegal downloads
Stories about lawful emulation, preserving devices, and memories tied to old gadgets are welcome.
4. Reports, blocking, and its limits — You may report a profile, story, or comment, and block another user at any time. You can view and undo your block list in the app. The Operator reviews reported content and acts as needed. Blocking only stops in-app visibility and interaction both ways — a web URL that is already public is not hidden per user.
5. Withdrawing a post — When you withdraw a post, the Operator unpublishes the server copy immediately. The local original on your device is not deleted, and removal from copies already replicated elsewhere, such as a search engine cache, is not guaranteed.
6. Community Guide — Using the community requires accepting the in-app Community Guide, separate from these Terms. See the app for its details.
7. Enforcement — If you post prohibited content or break Article 7 (Your duties), the Operator may hide posts, limit use, or suspend the account.

Article 10 (Liability)

Device details, prices and compatibility can be inaccurate; verify before a transaction or repair. Unavoidable events despite reasonable care are considered only as permitted by law. You should reasonably safeguard devices and backups.

Liability for attributable breach, privacy infringement or unlawful conduct follows applicable law. Intent, gross negligence and non-waivable consumer rights are not excluded. Liability is not automatically zero for free users or universally capped at the amount paid.

Article 11 (Governing law and venue)

These Terms are governed by the laws of the Republic of Korea. Disputes may be brought in a court of competent jurisdiction under the Civil Procedure Act. If the law gives priority to the court where the consumer lives, that rule applies.

Article 13 (Lounge and consumer rights)

Lounge posts and replies may appear immediately, unlike submissions for pre-review. Hiding a deleted Lounge post and physically erasing its text are separate procedures; see the Privacy Policy. Send report details for review and appeal restrictions or report handling at hello@gizmory.app. Nonconsensual intimate images and sexual deepfakes, child sexual abuse material, threats and doxxing are prohibited. Victims may report by email without an account.

Deleting the app or account, signing out or buying lifetime access does not itself cancel an existing renewing subscription. Check and cancel existing subscriptions in Apple/Google subscription settings. Web payments use the separate cancellation route disclosed at checkout.

Mandatory consumer law overrides store policies. Where Korean law applies, withdrawal is generally available within 7 days of the applicable statutory trigger. Nonconforming supply is subject to the applicable 3-month period from supply and 30-day period from learning of the issue. Digital-content commencement limits apply only when statutory notice, consent and other conditions are met. Merely viewing content does not waive every refund right.

The Korean governing-law clause does not remove mandatory protections or court rights in your US state or other residence. These Terms do not impose mandatory arbitration or a blanket class-action waiver. Continued use alone does not replace separately required consent.
